This image uses {{PD-ineligible-USonly}}. The home country of Spider-Man is the US, so the license template is incorrectly used here. If the image is ineligible for copyright, then the image can and should be moved to commons. If the image is copyright and not free, then it should be deleted as orphaned. Delete and move to Commons "This file is believe to be non-free or possibly non-free in its home country", whom? Spider-Man is from the United States, which had higher threshold of originality (simple logos like this are ineligible for copyright there).   • Speedy close (and by speedy close, I mean the file should be speedily kept). The file is not replaceable with the CCTV picture as the OP claims. Police alleges that the person in the CCTV image(s) is Mangione, but it is not 100% confirmed to be him; it would be a BLP violation to add that image to the Luigi Mangione article, much less the infobox. As for the file, it had already undergone extensive discussion less than two months ago at Wikipedia:Files for discussion/2025 January 17#File:Photo of Luigi Mangione taken by the Pennsylvania State Police in Altoona, PA.png, and there was no consensus to delete the image.     [I]t would be a BLP violation to add that image to the Luigi Mangione article, much less the infobox. Would it be a BLP violation to caption the CCTV image in the article generally (not necessarily the infobox) as something like "CCTV footage of a man believed to be Mangione"?     Even with words like "believed to be" or "suspected to be", there are implications and readers will be led to believe that Mangione is the one in the CCTV image since he's the one that was arrested. BLPs have much higher standards for inclusion; see Wikipedia:Biographies of living persons. Back to your FFD statement, the fair use image is not replaceable with that CCTV image until it is 100% confirmed to be him in that image. For now, the person in the CCTV image is only alleged to be him by LE (or alleged to be the shooter, not necessarily Mangione himself, since the CCTV images were released before Mangione was arrested).   • Speedy keep It's generally better to use the mugshot, especially since we don't even know if the guy in the CCTV is actually him. Regardless, keep for now since Mangione is serving a life sentence, might even get a death sentence, and no confirmed free image of Mangione exists.   • There is no reason to replace the following photo of Mr. Mangione due to this photo being the first time he was publicly seen, AND officially had confirmation that the currently selected photo is in fact him within the McDonald's. The other photo has yet to be confirmed as being Mr. Mangione, an you can't accurately see the features in the CCTV footage. I believe that photographs should be added to and not changed at all with the consideration in mind as well that this case will be used for future cases for many americans that hold constitutional violations. The original image is during the time of those violations because it leads you to later in the day he gets out of the police car with no shoes on.   • This is NOT acceptable not accurate. The image proposed is not confirmed to be the subject of this page. It would be liable to put the proposed new image.   • If anyone is wondering why a bunch of unregistered accounts have hopped onto this discussion all of a sudden, a link to it was posted on a subreddit dedicated to discussing Mangione and is gaining some traction.     I was wondering why there appears to be an influx of IPs today, so your comment answered that. Explicit, since you were the one that closed the related discussion two months ago, do you think you could close this one too? No one has !voted to delete the file so far, and I don't think three more days of discussion would be any productive now that there are off-wiki canvassing concerns.   • Keep Frankly the person from the CCTV image does not look at all like Luigi Mangione, therefore should not be used for his article.   • Keep, the only three states that treat CCTV and mugshots as public property are MA, CA, and FL. Even ignoring that he has the presumption of innocence, not a single photo that has been released since the shooting (suspect photos) and arrest (Luigi) is considered to be available for use under BLPCRIME. You either have to use a picture he himself posted on social media or allow the innocuous McDonald’s photo, which still allows him some presumption of innocence.
