The result of the discussion was: Delete. A freely licensed drawing is possible, therefore this file fails our non-free content criteria. The fact that the image is licensed under a CC BY-NC-ND 3.0 IT license qualifies this as a non-free image as far as Wikipedia is concerned, since it cannot be used for commercial purposes. This is no more original research than taking a photo of a building. If you create a free replacement of a coat of arms, then you look up the textual blazon and make a freely licensed drawing based on the blazon. If you create a free replacement of a photo of a building, then you look up the address of the building and walk there with your camera. It is very clear from Commons:COM:COA that all of them are replaceable. See the text on that page which says that "This means that anybody can draw a new coat of arms from a definition without copyright constraints: the "derivative work" notion simply doesn't apply in that case." The files in Commons:Commons:Deletion requests/Italian CoA appear to have been deleted because it:Wikipedia:Autorizzazioni ottenute/Stemmi isn't in OTRS (although Commons:Template:Grandfathered old file really should apply here) and because there was significant doubt about whether Araldica Civica is the copyright holder. For example, many of the images appear to be scans from books and were probably not created by the Araldica Civica users. This doesn't prevent anyone from creating a freely licensed image based on the blazon, though. --Stefan2 (talk) 12:15, 1 August 2013 (UTC)[reply]

Material from the http://www.araldicacivica.it/ website is released under a Attribuzione - Non commerciale - Non opere derivate 3.0 Italia (CC BY-NC-ND 3.0 IT) license. Which if I am understanding it correctly should be enough for us to host these particular files as fair use. That was the decision taken by the Italian wiki at the time of the discussion on the Commons. commons:Commons:Deletion requests/Italian CoA. The files were transferred to the Italian wiki from the Commons at that time, and I expect that's how we got our collection of stemma images as well. -- Diannaa (talk) 19:58, 1 August 2013 (UTC)[reply]

Delete, unfortunately. My explanation follows.

This case is similar in many ways to the recently-closed and much-discussed Canadian COA FFD. This case was put up at DRV here where it was endorsed eight times over. The closing admin should familiarize him/herself in the arguments made at those pages, and perhaps these FFDs should not be closed until the DRV is first closed.

In the Canadian COA case, the non-free COA is under Crown Copyright; in this and subsequent Italian cases, the COA is copyrighted araldicacivica, but the same principles apply. (1) This specific illustration of the COA is non-free. (2) The blazon upon which it is based is PD, and it should be possible for someone to create a new and accurate COA based on that blazon and release it under a free license. (3) This image could pass NFCC#1 only in an article that discusses this specific illustration of the COA in question, and not in one that merely discusses the COA in the abstract.

In this (and all other COAs listed on this page), the article does not mention the COA at all, but merely includes it in an infobox. Any accurate illustration of the COA would work equally well. I think we have to treat these COAs (like all COAs) with the same scrutiny we treated the Canandian one.

I would respond to Moxie's objection by saying that faithfully illustrating a COA from a blazon is not original research, it is making an original drawing, which is just as acceptable on Wikipedia as creating an accurate map or taking a faithful original photograph of a building. And I would respond to Diannaa's objection by saying that the cc-by-nc-nd license is considered "non-free" on the English Wikipedia, and images so licensed have to be considered the same as any other non-free image and must pass all our stringent non-free content criteria. – Quadell ^(talk) 11:52, 2 August 2013 (UTC)[reply]
