To quote the fair-use template already on this image

"for critical commentary on

the work in question,

the artistic genre or technique of the work of art or

the school to which the artist belongs"

Which artistic school does the UDR belong to?

Secondly, fair-use is a US construct. This is a UK image, protected under UK copyright. WMF practice (per the current mass deletions at Commons) is that images must be acceptable under _both_ source and US rules. Andy Dingley (talk) 23:53, 16 July 2013 (UTC)[reply]

KEEP The file is being used in an historical context, as small a version as is practical, to show Cpl Eric Glass, the most decorated UDR soldier wearing his decorations. This falls squarely into the acceptable use defined in Wikipedia:Non-free content#8. "Images with iconic status or historical importance: Iconic or historical images that are themselves the subject of sourced commentary in the article are generally appropriate." There is no other known image of Cpl Glass. The original image is in colour, this is a black and white downsizing. Therefore "minimal use" also applies. Wikipedia ignores non-US laws. For example, the article Eurovision Song Contest 2013 is illustrated using the image File:Eurovision Song Contest 2013 logo.png (a Swedish artwork), although illustrating an article with that image without permission from the copyright holder is illegal according to Swedish copyright law when the article is distributed in digital form, but Wikipedia doesn't care and uses the image anyway.

This image is clearly not needed for the article. There is zero critical discussion about what the man looked like. See WP:NFCC#8. --Stefan2 (talk) 16:16, 17 July 2013 (UTC)[reply]

Maybe not what he looked like but the image clearly shows him wearing the two awards which make him the "most decorated" soldier of the Ulster Defence Regiment and as such that makes the image historically important, as per Wikipedia:Non-free content#8.
