The result of the discussion was: Keep - NFCC#1 is a longstanding tradition that we don't allow non-free images of living individuals or bands - except in unusual circumstances. An incarcerated individual is such an unusual circumstance. Compare with my previous close at this image. [1] If you disagree with this assessment, you are of course welcome to take it up as a policy at WT:NFC or WP:DRV. As for the argument for NFC#UUI 7, this policy exists for professional organizations who vigorously claim copyright on their photographs (such that other newspapers can't even display them without a very compelling reason) - not for photographs that were released in a press-kit whose main purpose is its dissemination. Violates NFCC-use of non free file for living person. We hope (talk) 05:46, 25 February 2012 (UTC)[reply]
- file:Mouli_Cohen.jpg, was an attachment to multiple press releases on the subject of this article: Mouli Cohen. As far as I can tell, it perfectly meets all the requirements of the NFCC tag. This file was previously tagged for deletion, but supporting links and comments in the talk page were added, and no further discussion was put forward as to why the file should be deleted. Since the time the file was first uploaded, there has been no discussion about why it should be deleted. Please do not delete, or explain why it should be deleted. Thank you. - Delete Violates WP:NFCC#1: replaceable since the person is alive. --Stefan2 (talk) 21:10, 25 February 2012 (UTC)[reply]
Explanation of why the photo doesn't meet NFCC: Wikipedia:Non-free content#Images_2 " Pictures of people still alive, groups still active, and buildings still standing; provided that taking a new free picture as a replacement (which is almost always considered possible) would serve the same encyclopedic purpose as the non-free image. This includes non-free promotional images." We hope (talk) 18:05, 28 February 2012 (UTC)[reply]
- Don't Delete The subject is now in jail, for perhaps the rest of his life. See main article. It's unlikely that he would be available for new photographs. Ellis408 (talk) 07:54, 29 February 2012 (UTC)[reply]
- Wouldn't it be possible to create a free photo by visiting him in jail? --Stefan2 (talk) 13:44, 29 February 2012 (UTC)[reply]
- Yes, theoretically possible but not at all likely - as he's in federal prison and is probably not wanting to be photographed. A recent court document recommended a sentence of 30 years to life. I'm trying to track down his FBI mug shot as a replacement, and even though it would be public domain as a government document, it could be seen as a biased image of a living person. I think it's important to have an image of him, as he is convicted of multiple major scams involving hundreds of people and millions of dollars. Knowing what he looks like is an important public service, as he went by several aliases. I'm not clear on why a press kit photo, that does not mention any restrictions does not meet the conditions of a fair use of the photo - at least in my reading of the NFCC tag. Thanks, Ellis408 (talk) 17:52, 29 February 2012 (UTC)[reply]
- If it is a press image, it may additionally violate WP:NFC#UUI §7 which says that the use of press image is even more restricted than other images. --Stefan2 (talk) 20:35, 29 February 2012 (UTC)[reply]
- Hi Stefan2 - If you're referring to, "A photo from a press or photo agency (e.g., AP, Corbis or Getty Images)" that is not the case with this image. It is from a press release put out by the subject himself (not a press agency or photo agency). The press kit is still available, and I provided links to it. Thanks, Ellis408 (talk) 03:10, 1 March 2012 (UTC)[reply]
- After a full six days and no further discussion, I am removing the tags that are concerned about the use of the NFCC tag. thank you for participating. This file meets the definition. Ellis408 (talk) 19:00, 3 March 2012 (UTC)[reply]

The tags have been restored because the discussion about whether this photo meets NFCC or not is not done until closed by an administrator. We hope (talk) 20:09, 3 March 2012 (UTC)[reply]

Non-free TV episode screenshot. Apparently random scene; image is not object of analytical commentary; not necessary for understanding the scene depicted; meaningless boilerplate rationale. Fails NFCC#8. Fut.Perf. ☼ 13:29, 25 February 2012 (UTC)[reply]
