Prior publication has been provided in RC Cooper's 1960 work 'the Story of Regent's Park College', in which the image was used with permission from the Angus Library and Archive. There's no proof that the copyright for the image is owned by the Angus Library and Archive. The copyright for the image is typically owned by the photographer or their heirs or in some cases by their employer, if it was a work for hire. You could try to make a case for fair use regarding this image if it appeared in an article about the football team, but in an article about the college it fails our fair use guidelines. -- Dianna (talk) 14:38, 7 March 2013 (UTC)[reply]
The proof that the copyright was granted is contained within Cooper's work, what is the problem with this? I apologise but I fail to see an issue here. Tagged {{PD-Old-70}}, which states, "This file is in the public domain in countries with a copyright term of life of the author plus 70 years or less" (emphasis added). Apparently the photo was taken circa 1930, which means the photo itself is over 70 years old, but no evidence is provided that the photographer died over 70 years ago. There is no evidence that the photographer isn't known. All you have listed is a link to a page where the image isn't used. There is no information about its origin. How can you tell that it wasn't, for example, published in a newspaper when it was taken around 1930 with the name of the photographer indicated in the image caption?

Commons:Template:PD-Turkey describes the copyright status in Turkey, but Wikipedia uses United States copyright law, which works differently. For example, if it is anonymous and not published before 2003, then the copyright expires in the United States 120 years after the photo was taken. You have not provided any evidence that the photo was published before 2003. Also, even if it was first published before 2003, it may still be protected by copyright in the United States for some other reason. --Stefan2 (talk) 00:35, 7 March 2013 (UTC)[reply]

Unless Google Translate is completely wrong, it seems that the image caption doesn't tell whether the photo was published in the 1930s or not, let alone whether the photographer's name was indicated in any such publication. Also, even if the photo was published, URAA might be a problem. Turkish photos first published in the 1930s can only be kept if they entered the public domain in Turkey before 1996, because they are otherwise protected for 95 years since publication in the United States. I'm not sure if anyone has investigated the copyright term in Turkey on that date. The link to the Turkish copyright law at WP:Non-U.S. copyrights is dead, so it isn't possible to check whether the law has been unchanged since that point. --Stefan2 (talk) 13:21, 7 March 2013 (UTC)[reply]
