Speedy Delete: This file likely meets criterion WP:F6 for WP:SPEEDY, as the rationale provided by the uploader incorrectly claims fair-use on the grounds that use of the image falls under the "Non-profit educational" clause. If a proper rationale that actually relates to the image's purpose in the article was added to the file's description page, I could see the image meeting all 10 WP:NFCC criteria and therefore standing to be kept, however as it stands, the image also fails WP:NFCC#10c, and so it should be deleted. -- Fhsig13 (talk) 21:13, 10 March 2024 (UTC)- Comment: The image was taken by California Government, it should be in public domain and transferred to Commons (see here), but without sources, the file will be deleted and not transferred. Regardless, this image was uploaded on the grounds of fair-use (per the file information), for which an invalid rationale was provided. I still firmly believe that unless the uploader provides a rationale which actually relates to the article in which this image is used, it should be speedy-deleted as F6.The image content can still be reuploaded to Commons as PD separately. -- Fhsig13 (talk) 23:29, 10 March 2024 (UTC)- Comment: I have also found this for Ryan Hoyt, another higher resolution of Hoyt can be found here + I have also found this mugshot File:Jesse James Hollywood.jpg taken by Santa Barbara County Sheriff's Department located in California but the file has not a valid rationale, and should be deleted. - @Manchesterunited1234 Good Work. One could upload either of those pictures of Hoyt to Commons as PD and use it to replace the image in question, which will then meet WP:SPEEDY criterion WP:F8 as well. - It's PD (mugshots made by the government of California are). Change license to PD-CAGov and move to commons. PARAKANYAA (talk) 02:14, 12 March 2024 (UTC)
- @PARAKANYAA Based on your recommendation, I agree with moving the image to Commons and licensing it as PD. Once that is complete, the version in question can be speedy deleted as F8, if I am not mistaken. This file likely meets criterion WP:F6 for WP:SPEEDY, as the rationale provided by the uploader incorrectly claims fair-use on the grounds that use of the image falls under the "Non-profit educational" clause. This file may also meet criterion WP:F8, as a replacement has been found by @Manchesterunited1234, here. Lastly, this file also fails WP:NFCC#10c by the same token as my first point. I am seeking consensus rather than seeking outright speedy deletion, as a similar case is being discussed above. -- Fhsig13 (talk) 23:15, 11 March 2024 (UTC)

- @PARAKANYAA I don't think that's necessary, as this file already has a PD equivalent in Commons, which is being used in the same article, in versions written in other languages. I would recommend that the Commons version be substituted in the English article, and that this one should be speedy deleted as F8, in the interests of saving time & effort. -- Fhsig13 (talk) 03:45, 12 March 2024 (UTC)
