The link to the archived source website does not provide attribution/substantiation that this photo is in the public domain. Furthermore, if you go to that page now, it shows "Fair use image" as the description. Logan Talk Contributions 02:42, 29 August 2022 (UTC)[reply]

Comment At the time it was uploaded, the page used to say it's in public domain. See https://web.archive.org/web/20150518124655/http://www.blackpast.org/aaw/barnett-powell-s-1883-1971 which says "Image Ownership: Public Domain". But now they've changed it to say "Fair use image" :( – SD0001 (talk) 10:03, 29 August 2022 (UTC)[reply]
  • Delete - We do not have clear provenance for this file. The archived link does indeed state that the image is PD, but has been since changed. SD0001 uploaded this in good faith reliant on an explicit declaration of Public Domain, but the source site seems to have gotten it wrong and corrected it since. The archived site provides a source that they used for their article, "Historylink.org Online Encyclopedia of Washington State History, “Powell S. Barnett (1883-1971)” (by Mary T. Henry)" This archive is the oldest archive I could find which is from Oct 18, 2016 which is a bit after the archive of the source site used for this picture. That archive does not show this image used in the article. Oddly, the current site does have the image attributing it as CC0 to SD0001 which doesn't really help figure out the original source. Without this information, its impossible to determine the licensing. Conversion to non-free use is not supportable for a couple of reasons. WP:NFCC#4 for previous publication with permission from the copyright holder is unclear. WP:NFCC#1 as [1] includes a photo from 1900 which should qualify under c:Template:PD-US-unpublished as PD. -- Whpq (talk) 19:28, 29 August 2022 (UTC)[reply]
