- File:SM North Facade.jpg (delete | talk | history | links | logs) – uploaded by GretchBacayan (notify | contribs | uploads | upload log).
Found on Flickr at https://www.flickr.com/photos/keenesquivias1998/3888672486 (under All Rights Reserved licensing). Maybe the Flickr photo was on freer license before, but immediate search on archive.org yielded no archived sites for this particular Flickr link. Also, the user claims this as her own work, despite the Flickr user's name is Keen Esquivias. Whether there's a lack of freedom of panorama in the Philippines for copyrighted buildings & sculptures or there's an ongoing review on the country's copyright law to include FoP is now irrelevant at this point. Given GretchBacayan's apparent copyright violations (e.g. Wikipedia:Files for discussion/2020 October 29#File:SMMakatiNew.jpg and the first 3 files at Wikipedia:Files for discussion/2020 October 31), I am doubting that this is indeed hers or a photo stolen or a photo handed over. Maybe the physical ownership of the photo is transferred, but not the copyright, which remains with the photographer, whether he/she is a family member, a friend, a relative, a co-worker, or an associate. Copyright remains with the photographer until a written contract is undertaken transferring the copyright to GretchBacayan. For this particular image, a similar image was found at https://ohmski.blogspot.com/2008/07/sm-city-marikina.html?m=1. Although dated July 25, 2008 (later than the indicated upload date on Wiki which was July 6, 2008), there's no credit on the Omski Blogspot. Downloading the image from the Omski will give the same metadata as that of the Wiki image (normally for blog sites this would be impossible). By attempting to move this to Commons (once FoP becomes existing in the Philippines, should the IPOPHL's review on copyright law becomes fruitful), I might get an unpleasant warning there given the suspicious enwiki uploads of this user.
