The non-free use rationale for this file says that it is used "to provide critical commentary on the film, event, etc. in question or of the poster itself, not solely for illustration" (emphasis mine). The article it is used on, Intersex people and military service in the United States does not provide any commentary on it whatsoever, and indeed uses it just for illustration. cymru.lass (talk • contribs) 20:21, 20 November 2018 (UTC)

There are two problems with this image. Firstly, it has a proprietary watermark from a commercial image-hosting site embedded into the file, which photos intended for use on Wikipedia are never allowed to have. Secondly, the copyright claims are completely out to lunch: the source is claimed as "originally published in Toronto Star" with Getty Images as the "immediate source", but then the copyright tag claims Crown copyright — which would mean that (a) it was owned by the Canadian federal government, which it isn't, and (b) even if it were, it still couldn't be kept anyway because Crown-copyright content is incompatible with Wikipedia's copyright requirements and cannot be used here at all.
As always, a user cannot just upload any photo they find on a web search, regardless of its existing copyright status, and call it "fair use" -- if they can't find an existing photo that's been licensed under GFDL, Creative Commons or public domain, then their only other alternative is to take a new photo themselves that they're willing to release under GFDL, Creative Commons or public domain from the jump. - Speedy Delete per F7. It is clearly not Crown Copyright as claimed since this comes from the Toronto Star. The Getty watermarking makes it clear that the photographer is intending to earn additional commercial revenue by making it available through Getty Imaages. -- Whpq (talk) 23:55, 20 November 2018 (UTC)
