The result of the discussion was: Consensus is to Keep the image. Diannaa (talk) 22:24, 9 September 2013 (UTC)[reply]

Unneeded to understand article. Beerest355 Talk 13:22, 8 August 2013 (UTC)[reply]
- Weak keep - the requirement is not "needed for understanding", but "significantly increases understanding". As such it's a weak keep imo, readers unfamiliar with the series (or with the hulk) will benefit from that image. Even readers familiar with the topic will get a better understanding about this episode's main point. GermanJoe (talk) 07:40, 9 August 2013 (UTC)[reply]
- There's nothing in this image that can't be conveyed with text - heck, the image's caption does exactly that.Beerest355 Talk 18:26, 9 August 2013 (UTC)[reply]
- Keep - Screencaps of television episodes are ipso facto relevant to articles about the episodes. One gains a better understanding of the episode simply by looking at the image. To state anything else is a form of extreme reductionism attacking fair use itself. Magog the Ogre (t • c) 21:31, 17 August 2013 (UTC)[reply]
- Keep - The image of Homer looking like a "Hulk" is not triumphed by free text. Even when people know the Hulk, omitting the image of parody in favor of text would lessen Wikipedia's ability to understand the scene well. --George Ho (talk) 18:40, 9 September 2013 (UTC)[reply]

The result of the discussion was: Keep. The photographer and the sculptor are the same person - the OTRS ticket says the photographer is Zenos Frudakis. By releasing the photograph under a free license, the author is releasing all elements of the photograph as free. Thus, this photograph of the sculpture is released as free. This does not mean that the 3D artwork is free, but rather that the author is releasing all claims to a derivative work in this actual photograph of it. Absent any case law to the contrary, this seems like common sense to me. Magog the Ogre (t • c) 15:26, 18 August 2013 (UTC)[reply]
- File:Zenos Frudakis Jack Nicklaus Louisville.jpg (delete | talk | history | links | logs) – uploaded by User:Forgottendelights | contribs | uploads | upload log).
The OTRS permission covers only the photograph. The image is a DW of the sculptures and in order to keep it we need a license from the sculptor. . . Jim - Jameslwoodward (talk to me • contribs) 20:34, 8 August 2013 (UTC)[reply]
- Comment the sculptor is Zenos Frudakis, the photograph says it's from Zenos Frudakis, where's the problem? Does the OTRS ticket say something different? Is it not by Zenos Frudakis ? -- 76.65.128.222 (talk) 03:07, 9 August 2013 (UTC)[reply]
- Because a third party copyright is involved (there is no evidence that the uploader, User:Forgottendeleights, owns the copyright for the sculptures), we require OTRS permission. As to that, I can only repeat what I said above -- the OTRS permission speaks only to the photograph (and others) and does not say anything about licensing the sculptures. This may simply be an error or misunderstanding, but it must be rectified if we keep this image. . . Jim - Jameslwoodward (talk to me • contribs) 10:08, 9 August 2013 (UTC)[reply]
- As I cannot read the OTRS ticket, but only read the information template on the file page, and the Zenos Frudakis article, it states that the photo was created by Zenos Frudakis, and the sculpture itself was created by Zenos Frudakis. If the OTRS ticket does not match the information in the information template, shouldn't some OTRS person fix that? -- 76.65.128.222 (talk) 10:58, 9 August 2013 (UTC)[reply]
- As I said above, the OTRS ticket gives permission only for the photograph (and a number of others). It does not give any license for the use of the sculptures. The OTRS template tells the truth, but not the whole truth -- we have permission for the photograph, but that is not sufficient. This is not an unusual situation.
- Also I'm not sure why you say
- "it states that the photo was created by Zenos Frudakis".
- The author of the sculptures is certainly Zenos Frudakis. It's not clear who the Author line in the description refers to -- the author of the photo or the author of the sculptures. Since we have a relatively large image and full EXIF data, it seems reasonable to assume that the author of the photo is the uploader, User:Forgottendelights, not the sculptor. . . This is an orphaned photo of a group called the "Patterns Book Club", the article of which was speedily deleted by A7. As a file illustrating a non-notable group, it does not meet the scopes of Wikipedia or the Commons. Michaelzeng7 (talk) 22:02, 8 August 2013 (UTC)[reply]
