The result of the discussion was: delete. As per the conversation linked below, the permission is insufficient to release as a free license, and the image fails NFCC criterion #8 as mentioned by the nominator as (2). Non-free photograph of an athlete who died recently. Problematic under NFCC for two reasons: (1) No evidence is presented that any serious attempts were made to locate a free alternative or approach copyright holders who might be willing to grant a free license (which seems quite likely for a recently deceased former college football player. Are there no fellow students, fans or team mates who would love to contribute to honouring his memory with a good free photograph?) (2) The image has so far been kept on the grounds of the usual biography-of-deceased-person rationale. However, it fails the justification for that rationale for a very plain reason: it doesn't even show his face. He's wearing a helmet. The photograph just shows a generic, unidentifiable shape of an athlete running with a ball; hence, it doesn't fulfill the purpose that the standard rationale presupposes: tell us something significant about this individual's personality that could not be conveyed otherwise. Hi Future Perfect--thanks for your input. The thing is, this is a freely-licensed photograph, or at least I think it is. I obtained direct permission from the copyright holder, whom I personally know. As an uploading newbie, I haven't really been able to glean any good information on what exactly else--if anything--I need to do from this point forward to confirm this fact.
(Stefan--I have mentioned to you before that I think there's an IP ban on your particular IP range for that website, which serves as a message forum, among other things. Not that you should have to, but I think if you attempt to access the source link through a proxy, you'll be able to see the picture fine. e.g. https://www.megaproxy.com/go/_mp_framed?http://www.cactusranch.com/crgallery/main.php?g2_itemId=15184 -- However, I can ask the creator of the image to move it to a non-IP restricted place if that will help.)
My other question for you, Future Perfect, relates to the second problem--as long as we resolve (1), does the issue with the biography rationale become moot so that we need not worry about it? Thanks, Justin Z (talk) 02:31, 13 April 2013 (UTC)[reply]
- The NFCC issue will become moot only if we get a fully free license for it. You didn't provide any evidence about what kind of license terms you got from the owner, but you indicated it wasn't a fully free one, so for the moment we have nothing else to go by than this information. - I can see the image at the url provided, and the image has this information posted on it: "These photos are copyright Robert Kline and Cactus Ranch.com and are intended only for the private non-commercial use of individuals. Any other use or reuse of these images is prohibited without the expressed consent of Cactus Ranch and Robert Kline." The uploader's talk page shows that I advised him on 24 February to get an OTRS ticket in place on the item if he has received the copyright holder's permission to display it here, but so far no ticket is in place on the file. -- Dianna (talk) 00:30, 20 April 2013 (UTC)[reply]
