- Keep - I don't see any reason why we need to delete this. The grave is in the public domain and is located on a United States government facility not subject to Copyright. Regardless of what the Arlington Cemetery.net website may infer it does not own the rights to an image of the grave taken by a private individual nor does it it own the rights to the gravesite. This is different than taking a picture of a painting or sculpture in a studio. --Kumioko (talk) 19:44, 1 February 2012 (UTC)[reply]
- Keep - In addition to what Kumioko has stated, I believe the image falls into the Fair Use category under the following reasons: First, there are no apparent free equivalents or alternatives to the photographs of Rene Gagnon's headstone to be used in Gagnon's article. Second, there's no infringement to commercial purposes for images of Rene Gagnon's headstone at Arlington. Third, the image has an important encyclopedic use in illustrating how Gagnon is memorialized in death by for his role in the raising of the flag at Iwo Jima. (A larger scale example would be Lincoln's tomb of which there are multiple photographs on Wikipedia). Particularly, Gangon was re-interred in Arlington National Cemetery after first being buried elsewhere. The fact that his body was moved and then honored with this unique memorial with an addition to a standard military headstone is important unto itself. The photograph thus significantly adds to a reader's understanding of how the United States viewed the men involved in the raising of the flag at Iwo Jima and its absence would be detrimental. Fourth, this image has a home and a use. It will not exist merely to exist. Fifth, it's use is minimal. ~ (The Rebel At) ~ 22:08, 2 February 2012 (UTC)[reply]
- Delete. Cannot be kept as a public domain image because it contains a derivative work, not de minimis, of the copyrighted picture Raising the Flag on Iwo Jima, and of the bronze relief thereof. Cannot be kept as a fair use image because it lacks the required fair use rationale and it is not clear that it is necessary to improve the reader's understanding of the related article (WP:NFCC#8). - Crop so that the unfree back is no longer visible. The back doesn't provide any useful information anyway, per WP:NFCC#8; we already have a better image of Raising the Flag on Iwo Jima, and there isn't much else there. Now, if we were planning on using this to show what these graves look like in general, that might be a different case.
