- Non-free image being used to show what a living person looks like. I can't find the discussion that allowed it to survive speedy deletion. There is nothing in the image that would not allow it to be replaced by another image of this person, nor is the photo itself of historical significance. - No, it doesn't. He's a living person so a photo can be created. We don't have to wait for the creation of a free photo. The fact that one can exist is enough to not allow a non-free one. - The only reason I didn't put it for speedy is that the image is marked as already having survived a speedy. I could not find the discussion that allowed that to happen. Bringing it here avoids edit warring. But it would be Wikipedia policy, not copyright law. I don't believe US copyright law makes any mention of being replaceable. - The picture should not be deleted. The text talks about the HIStory World Tour, and this picture shows what the performance was like. This is the only picture that shows him performing at one of his official world tours on the whole wikipedia page of Michael Jackson.. Michael Jackson was a singer AND a dancer, and the HIStory World Tour is amongst his highest grossing and most popular world tours. For that reason I think the picture should be kept. - This should be nominated for speedy deletion on grounds that it is copyrighted and other free-use images of the singer are currently available and in use. The fair use rationale is entirely contingent on the fact that no free-use image of the subject can plausibly be found. This article about Michael Jackson already has several fair-use images on that subject, and adding copyrighted images to show the subject at a preferred time or participating in a preferred activity does not illustrate a distinct subject, so we can see the replacability element of this fair use rationale is incorrect in its assertion.
