- Original uploader did not put this in the public domain, that tag was added by another user. Regardless, it is a photo of a 3D work of art, and is therefor not free. It is not valid as fair use unless the article is about the statue itself, which it is not. ▫ JohnnyMrNinja 04:51, 21 March 2009 (UTC)[reply]

- No publication date stated. Is this definitely PD-US? Papa November (talk) 10:39, 21 March 2009 (UTC)[reply]
- Keep, public domain. As the article notes, label was only in business from 1930 through 1932. Definitely PD-US no mater which of those three years this was printed in. No statement of copyright on U.S. printed material from this era = public domain per U.S. law. -- Infrogmation (talk) 14:19, 21 March 2009 (UTC)[reply]

The result of the discussion was: delete. Per the Wikipedia non-free_content guidelines using a book cover to illustrate the article on the person whose photograph is on the cover is an unacceptable use of a copyrighted image. -Nv8200p talk 02:47, 4 April 2009 (UTC)[reply]
- Non-free book cover being used to illustrate a person on the cover (i.e. not the book itself) Papa November (talk) 10:40, 21 March 2009 (UTC)[reply]
- Even when said person is the author? This is just the kind of fiddly distinction that gives me a migraine. But, if it's gotta go... (sigh) Lee M (talk) 21:59, 21 March 2009 (UTC)[reply]
- There must be a promotional image somewhere that could be used instead? That would certainly be fair use, given that the subject is dead. Papa November (talk) 09:28, 22 March 2009 (UTC)[reply]

- Crop of sheet music cover used to illustrate a person rather than the music itself. This may be OK if the image is pre-1923. Alternatively, given that the subject is dead it may be possible to use {{Non-free fair use in}} instead. Papa November (talk) 10:53, 21 March 2009 (UTC)[reply]
- It was common in the era for a promotional photo noted singers to be printed on covers of sheet music; this photo came from such an example. As no free licensed image of Morton Downey has been located, until/unless one is I don't see a problem. Keep, low-res period photo of the subject of the article labled as fair use; no replacement suggested. -- Infrogmation (talk) 14:13, 21 March 2009 (UTC)[reply]
- OK, how about changing the tag to {{Non-free promotional}}? Papa November (talk) 22:25, 21 March 2009 (UTC)[reply]
- Done. I don't know why tag had been changed to "book cover". -- Infrogmation (talk) 02:05, 22 March 2009 (UTC)[reply]

<- Withdraw nomination: Thanks. I changed it because the {{non-free unsure}} tag is deprecated in favour of more specific tags. Papa November (talk) 09:25, 22 March 2009 (UTC)[reply]

- Uploader claims on the image page that he took this photograph, but now states that this is not the fact - others "handed them over to me". There is still no source for these images and no proof that the uploader is the (c) holder of any of them. From my talk page:

- Violates WP:BLP, WP:LIBEL, and the general requirement that pages may not exist solely to disparage their subjects. The basic rules of Wikipedia don't just apply to article space; if this isn't deleted, I would take it as evidence that WikiWorld is apparently immune to the rules of Wikipedia.
And for the record, I don't like Ann Coulter either. But this reflects badly on the Wikipedia project. Chardish (talk) 19:18, 21 March 2009 (UTC)[reply] - Comment It appears to be a Commons image.--Rockfang (talk) 19:40, 21 March 2009 (UTC)[reply]
