- This was tagged with {{di-replaceable fair use}} but was contested with "Following an extensive search, no other images of subject exist online from 1995 era (when the individual was most relevant) and one State Department image from 2007 is a group photo w/ poor resolution". I believe that this still isn't a good rationale for the use of a non-free image because: A) The time that a person was most relevant doesn't really matter... if a free image of a person can be found, that free image should be used, even if it is ~10 years newer; and B) He is still alive, so a free picture can be taken. - Thank you for looking into this. I certainly did look for a free image, but found none (save for a thumbnail-size low-res group photo from the State Dept. which cannot be edited due to its format). As I do not live in Argentina, and the subject has lived a relatively low-profile life since 2007, the chances of having someone take his picture are very slim. There are, of course, a small number of recent online newpaper photos - though asking them for permission is unrealistic. The website using the '95 photo (Todo Argentina) is an educational site and provided no copyright on the image (which they most likely scanned from an old magazine). What I propose is limiting its use to José Octavio Bordón and Argentine general election, 1995, if you think it's at all possible. Thanks again, Sherlock4000 (talk) 06:51, 29 July 2009 (UTC)[reply]
- Delete, we even have a free image. Not a great one, but it could be cropped. The fact we already have a free image, and the fact you found another small one, means there may be more out there, or even more to be created, as he's still alive. - Delete The foundation is pretty clear about this. See Foundation:Resolution:Licensing policy point 3. Unless there is something particularly notable about this person's appearance based on the time of the fair use image, it's considered to be replaceable with a free one, even if a free one doesn't currently exist, so long as the person is alive. A case where a fair use image is appropriate for depiction of a living person is the top image at Lakshmi Tatma. - Please keep in mind that, per Argentine Statutory Law 11.723, article 31, "the photographic portrayal of a person is free (of copyright restrictions) when it is related to scientific, educational, or cultural purposes" (Ministry of Science and Technology). The use of this image in these two articles would be included in this provision. I hope this helps.

- There was a misunderstanding, and it was my fault. The relevant statute (11.723/31) states in its second section that photos of individuals are also free of copyright when "they pertain to events of public interest or which took place in public." The image of this candidate during a presidential campaign in which he was the runner-up is included in this clause.

- The image has a free license tag and a non-free rationale, which needs to be fixed as they're inherently contradicting each other. There are seven separate screenshots on this article, which would be too much even if it were free (is it? the article isn't clear). And this image uses a copyrighted picture as well. I recommend deletion as the last part can't be fixed; if the software itself is free (or the screenshots are released), then a screenshot of editing a free image would be appropriate. Source website claims to be "Copyright © 2003-2004 State of Florida". The linked template states that "Florida's Constitution and its statutes do not permit public records to be copyrighted unless the legislature specifically states they can be." As there's a copyright notice, it seems fairly clear that this is one of the cases where the content is permitted to be copyrighted. J Milburn (talk) 23:12, 29 July 2009 (UTC)[reply]
- I'm quite aware of that claim. What part of This file is in the public domain, because see commons:Template:PD-FLGov do you not understand? If I put the following in larger print, will you read it?
This file is part of the "public record made or received in connection with the official business of any public body, officer, or employee of the state, or persons acting on their behalf, [which includes the work of] the legislative, executive, and judicial branches of government and each agency or department created thereunder; counties, municipalities, and districts; and each constitutional officer, board, and commission, or entity created pursuant to [Florida] law or [its] Constitution" (Florida Constitution, § 24) such as "[a] document[], paper[], letter[], map[], book[], tape[], photograph[], film[], sound recording[], data processing [program], or other material, regardless of the physical form, characteristics, or means of transmission, made or received pursuant to law or ordinance or in connection with the transaction of official business by any ['state, county, district, authority, or municipal officer, department, division, board, bureau, commission, or other separate unit of government created or established by law' of the State of Florida]" (definition of public work at Fla. Stat. § 119.011(11)), and does not fall into any of the various categories of works for which the legislature has specifically permitted copyright to be claimed (see, e.g., "§ 24.105(10), Fla. Stat. (2003) [authorizing the Department of the Lottery to hold copyrights]; § 601.101, Fla. Stat. (2003) [permitting the Department of Citrus to hold legal title to copyrights]; § 1004.23, Fla. Stat. (2002) [authorizing universities to secure copyrights in certain works]" [summaries in original]). It is consequently in the public domain according to court interpretation of the Florida Constitution, Article I, § 24(a) and Florida Statutes, § 119.01. See Microdecisions, Inc. v. Abe Skinner (Findlaw): "Florida's Constitution and its statutes do not permit public records to be copyrighted unless the legislature specifically states they can be".

- I have reviewed this situation again, and contacted MBisanz, someone more knowledgable of the subject matter (Florida copyright law is hardly a strongpoint of mine...)
