- Keep retag per Wikipedia:Non-U.S._copyrights#Wartime_copyrights. This picture of Ki-43s on the flightline undoubtedly took place during WWII accordingly, it would very likely fall under the aforementioned exception and would be PD under these rules. Delete, very few WWII-era images are PD in the U.S. In Germany copyright lasts 70 years after the death of the photographer, and in nearly all cases the U.S. respects that copyright. The source here is not sufficient. – Quadell (talk) 12:38, 27 April 2009 (UTC)[reply]- I realize the issues with regard to German PD law and the whole EU copyright furball, but this is a Japanese fighter, not a German fighter (note the rising sun emblem/"meatball" on the fuselage). - Ah, so it is Japanese. It's still tricky, I'm afraid. The section you reference concerns copyrights administered by the Alien Property Custodian. Certain copyrights held by the Japanese and German governments were taken over by the APC at the conclusion of the war, and these were later placed into the public domain. Unfortunately, there is no list of what copyrights were held by the APC, and figuring it out for a particular work is a bitch. (The U.S. Copyright Office frankly says it doesn't know.) Anyway, this doesn't apply to works whose copyright was held by individuals. If this was a photo created by someone who died in the war, it would now be in the public domain, since Japanese law protects copyright for photos for 50 years after the death of the author. But if the photographer lived past 1959, it would be copyrighted. Or if this were created by a corporate entity, copyright only lasts 50 years from publication, so it would almost certainly be PD. If this was a frame from a movie, it would be PD regardless, since all films produced in Japan before 1953 are PD. But not photos. Basically, without a source, we can't tell if this is PD or not. – Quadell (talk) 23:17, 28 April 2009 (UTC)[reply]
- But it was taken on a military installation during the war (these planes were only used during the war). As such, the person taking it was either military (given the angle and quality, it seems to be more than likely to be a government photo) or a government official. In either case, it would fall under PD under the previously referenced section. I also agree that, without a direct source, it is hard to figure out, but I think, in this case, it can be inferred. — BQZip01 — talk 01:09, 29 April 2009 (UTC)[reply]

- Weak keep. This is a case where (a) the sourcing is really weak, (b) it is extremely likely that the image is PD, (c) this can't be conclusively shown, and (d) if the image were copyrighted, the value of copyright to the holder would be negligible. In these cases, I'd recommend we call these PD (tagged here {{PD-Japan}} and {{NoCommons}}). - Obsolete. I did not take this screenshot when I uploaded it back in 2004 (policies were looser back then, and I was a new editor). I just noticed that this was still around, so I created File:FinalFantasyTacticsAdvanceGBAScreenshot.png, which is intended to replace it and better illustrates the subject, I think.
