In French Law the Code de procédure pénale is the code of law that compiles legislation relative to criminal legal procedure.

The code de procédure pénale was elaborated at the end of the French Fourth Republic with the promulgation of the preliminary title and of Book I, through the loi 57-1426 of 31 December 1957.^[1] On his return to power, General Charles de Gaulle accelerated the preparation of this code, and promulgated books II to V when the new institutions of the French Fifth Republic were put into place, through ordonnance 58-1296 of 23 December 1958.^[2]

The code took effect on 2 March 1959 in metropolitan France, at the same time as the judicial reform that de Gaulle had wanted. It took effect on 1 March 1962 in the Overseas departments and regions of France, as was also planned for French Algeria.

As for the French overseas territories, the code was put into effect by the loi 83-520 of 27 June 1983. Ordonnance 96-268 of 28 March 1996 extended the totality of the code to these territories and created Book VI.

The code de procédure pénale has two imperatives: ^{[citation needed]}, echoing the ideals declaimed by the French Resistance and the need to assure a dignified procedure (accuracy of evidence, no forced confessions, no use of narcotics).

It has three principal objectives:

reinforce individual liberty;
reinforce the autority of magistrates;
reinforce the efficiency of criminal procedure.
