[edit]The non-lucrative residence residency is a visa offered by Spain to non-EU citizens who possess ample financial resources to reside in the country without seeking employment or engaging in other professional activities. This pathway serves as one of the most straightforward methods to obtain permanent residency in Spain, given that the income and savings requirements are met. The visa is also available to the following family members:
- Spouse or unmarried partner.
- Dependent children and dependent relatives in the ascending line who are part of the family unit.
Who can apply
[edit]Visa applications must be submitted in person by the applicant or, if the applicant is a minor, by one of their parents.
Where to apply
[edit]Applications must be submitted in person at the Consular Office, and an appointment is required. Applicants must legally reside within the jurisdiction of the Consulate General. B1/B2 visa holders must apply for the visa in their country of legal residence. Honorary Consulates of Spain are not authorised to process visa applications.
Decision period
[edit]The legal period for reaching a decision is three months from the day after the application submission date. However, this period may be extended if an interview or additional documents are required.
Visa collection
The visa must be collected in person by the applicant or their legal representative (in the case of a minor) within a maximum of one month from the day following the notification of a favourable decision. The Consular Office will provide instructions for the return of the passport and any other original documentation.
Appeal
If a residence permit or visa is refused, the applicant can submit an appeal for reconsideration to this Consular Office within one month from the date of refusal notification. Alternatively, an application for judicial review can be filed with the High Court of Justice of Madrid within two months from the date of receiving the refusal notification or the dismissal of the reconsideration appeal.
Validity period of the visa
The visa will be valid for 90 days. Once in Spain, a Foreigner Identity Card must be applied for within a period of 1 month from the applicant's entry into Spain, at the Foreign Nationals' Office or the corresponding Police Station.
