United States federal regulations (such as the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), the Oil Pollution Act (OPA), and others) require polluters to cleanup unauthorized releases of hazardous substances and oil[1][2]. Additionally, these federal laws allow natural resource “trustees” to perform Natural Resource Damage Assessment and Restoration (NRDAR), or just Natural Resource Damage Assessment (NRDA),[3][4]. In the United States, federal, state, or tribal governments may act as trustees for natural resources[5][1][2]. While methods for performing NRDA can vary[6][7][8][9][3][10][11][12], the steps are well established in CERCLA and OPA.

In the United States, natural resource trustees are designated by federal, state, and tribal governments[5][13][14][3][1]. Federal trustees are designated by the President of the United States, and often include NOAA (through the Office of Response and Restoration) or USFWS. State trustees are appointed by their state's governors and tribal trustees are appointed by their governing bodies[15][5]. Every state has designated one or more trustee organizations[16], however not all states have active natural resource damage programs prepared to respond after an accident [17][18].

In the United States, responsible parties must reimburse trustees (the trustee organizations performing the NRDA) for restoration and for the cost of assessing the injury[4]. In the United States, reimbursement covers: 1) the reasonable cost of assessing damages (attorney fees, monitoring, research, and participation at trustee meetings) 2) the cost of restoring/rehabilitating until full recovery of the resources (or acquiring the equivalent of the injured natural resources), and 3) lost past-use of ecosystem services for legacy releases[1][7][4].

In the United States, injury to natural resources can be the result of exposure to hazardous substance, the cleanup itself (driving machinery through habitat) or even actions in response to a threat of a discharge[1][2][19]. Natural resource valuation is performed during natural resource damage assessments. Trustees must quantify the severity of injuries, determine how much the responsible party owes the public (often defined in monetary damages)[20], and then develop restoration plans to restore ecosystem services[1][7][9][14]. The US Department of the Interior maintains a library of NRDA cases for public access, for NRDA cases in which the US DOI is involved[21]. The US National Oceanic and Atmospheric Administration maintains a library of NRDA cases for public access for NRDA cases in which US NOAA is involved[22].

Individual states in the United States may either use the federal process defined in CERCLA and OPA or use their own state regulations[18][23], although not every state has adopted their own NRDA regulations[13].

Other countries have similar procedures to determine injuries due to releases of hazardous substances and to determine the level of restoration that would offset those injuries in their own regulations[24]. Additionally, NRDA regulations from the United States have been used for assessment of natural resource injury abroad[25]. The US NRDA process is similar to the European Union's Environmental Liability Directive 2004 in that both are systematic and science‐based analyses of ecological injuries[26][27].
