The primary legal instrument for data protection in Niger is Law No. 2017-28, adopted on 3 May 2017. 2. Establishment of the Data Protection Authority
Niger established the Haute Autorité de Protection des Données à caractère Personnel (HAPDP) through Law No. 2019-71. This independent authority is responsible for ensuring compliance with data protection laws, receiving notifications of data processing, issuing authorizations, and enforcing sanctions when necessary.[2]
3. Expanded legal framework and international alignment
In December 2022, Niger adopted Law No. 2022-59, which expanded the scope of the existing data protection framework to cover biometric data, big data, video surveillance, cybersecurity, and emerging digital technologies.[3]
