Data protection laws in Niger refer to the legal and regulatory frameworks established to safeguard personal data and privacy of individuals within the Republic of Niger. The country has enacted legislation to regulate the use of personal data and to protect the privacy rights of individuals, in line with regional and international standards.

1. Law No. 2017-28 on the Protection of Personal Data

The primary legal instrument for data protection in Niger is Law No. 2017-28, adopted on 3 May 2017. This law governs the processing of personal data and sets out principles for lawfulness, fairness, and transparency in data collection and usage.<ref>{{cite web |title=Niger: Law No. 2017-28 of 3 May 2017 on the Protection of Personal Data.[1]

2. Establishment of the Data Protection Authority

Niger established the Haute Autorité de Protection des Données à caractère Personnel (HAPDP) through Law No. 2019-71. This independent authority is responsible for ensuring compliance with data protection laws, receiving notifications of data processing, issuing authorizations, and enforcing sanctions when necessary.[2]

3. Expanded legal framework and international alignment

In December 2022, Niger adopted Law No. 2022-59, which expanded the scope of the existing data protection framework to cover biometric data, big data, video surveillance, cybersecurity, and emerging digital technologies.[3]

The 2022 law and subsequent amendments brought Niger's data protection framework closer to international standards. Niger is a signatory to the African Union Convention on Cyber Security and Personal Data Protection (Malabo Convention) and has taken steps toward alignment with the Council of Europe's Convention 108+[4]
